FusionGlassArt - International Terms under Thai Law
1. Scope of Application
These Terms & Conditions apply to all orders placed through the FusionGlassArt online store and to all business relationships between FusionGlassArt and its customers.
Sales are conducted internationally, primarily to customers in the United States, Switzerland, Singapore, the United Arab Emirates, and other non-EU jurisdictions.
Orders from the European Union are accepted only upon individual request and are subject to separate confirmation.

3. Nature of Handmade & Made-to-Order Products
All FusionGlassArt products are handcrafted using fusion glass techniques.
Due to the artisanal production process:
- Each piece is unique.
- Variations in color, texture, thickness, bubbles, or shape are inherent characteristics.
- Such variations do not constitute defects.
Certain products are made to order or individually crafted upon purchase. These items are produced specifically for the customer after the order is placed.
4. Ordering & Contract Formation
By placing an order, the customer submits a binding offer to purchase the selected products.
A contract is concluded only when FusionGlassArt confirms the order by email or dispatches the goods.
FusionGlassArt reserves the right to decline orders without stating reasons.
5. Prices, Taxes & Duties
All prices are shown in the currency displayed in the online store.
Unless explicitly stated otherwise, product prices do not include import duties, customs fees, local taxes, or other charges imposed by the destination country.
For orders shipped to the United States, FusionGlassArt ships DDP, Delivery Duty Paid. This means applicable import duties and taxes are handled in advance, so US customers should not receive a separate customs duty invoice on delivery.
For destinations outside the United States, import duties, customs fees, taxes, or local charges may apply unless clearly stated at checkout. These charges are the responsibility of the customer.
FusionGlassArt has no control over customs inspections, customs processing times, or delays caused by local authorities or carriers.
If a US customer is asked to pay import duties on delivery, they should contact FusionGlassArt before making payment and provide a copy or photo of the carrier notice.
6. Payment Methods
Accepted payment methods may include:
- Major credit cards
- PayPal
- Bank transfer, upon request
Payment must be completed in full before production or shipment begins.
7. Production & Processing Time
Ready-to-ship pieces are usually prepared for dispatch within 3 to 7 business days, excluding shipping time.
Some FusionGlassArt pieces are made to order, customized, or produced in limited batches. These items may require additional production time. The applicable production or availability information is shown on the individual product page before purchase.
Each piece is made through a controlled kiln-fusing process, including cutting, forming, firing, cooling, and finishing. Processing times may vary depending on the nature of the piece, order volume, and current production schedule.
Estimated production and delivery timelines are provided for guidance only and are not guaranteed unless expressly confirmed in writing.
8. Shipping & Delivery
Shipping is carried out to the address provided by the customer at checkout.
Delivery estimates begin after dispatch and are provided for guidance only. Ready-to-ship pieces and made-to-order pieces may have different preparation times, as stated on the individual product page or in the Shipping Policy.
For orders shipped to the United States, FusionGlassArt ships DDP, Delivery Duty Paid. Applicable import duties and taxes are handled in advance.
FusionGlassArt is not responsible for delays caused by shipping providers, customs inspections, local authorities, incorrect or incomplete delivery information, or force majeure events. This does not affect any mandatory consumer rights.
If an item arrives damaged, the customer must contact FusionGlassArt within 48 hours of delivery and provide photos of the item, packaging, and shipping label. FusionGlassArt will review the case and arrange an appropriate solution where the damage occurred during transit.
Failure to report visible transit damage within this timeframe may limit our ability to verify the damage with the carrier. This does not affect any mandatory consumer rights.

9. Relationship with Shopify
FusionGlassArt is powered by Shopify, which enables us to provide the online store and related services to you.
However, any sales and purchases made through the store are made directly with Fusion Glass Art Co., Ltd.
By using the store, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and FusionGlassArt, including any injury, damage, or loss resulting from purchased products and services.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with FusionGlassArt.
10. Returns & Cancellations
10.1 Standard Products
Returns are accepted only if:
- The product is unused.
- The product is returned in original condition and packaging.
- The return request is made within 14 days of receipt.
Return shipping costs are borne by the customer unless otherwise agreed.
10.2 Made-to-Order & Customized Products
Products that are made to order or individually crafted for the customer are excluded from returns and cancellations, unless the item arrives damaged or defective.
This does not affect any mandatory consumer rights that cannot be excluded or limited by law.
11. Damaged or Defective Items
Customers must inspect items immediately upon receipt.
Any damage or defect must be reported in writing within 48 hours of delivery, including photographic evidence.
Failure to report visible transit damage within this timeframe may limit our ability to verify the damage with the carrier. This does not affect any mandatory consumer rights.
12. Warranty
Warranty rights apply in accordance with applicable mandatory consumer protection laws of the customer’s country of residence, where legally required.
FusionGlassArt pieces are made through a controlled kiln-fusing process. Subtle variations in color depth, texture, surface movement, dimensions, or edge character may occur and are part of the nature of kiln-fused glass.
Such material and process-related variations are not considered defects, provided they do not affect the functional use, food-safe surface, or structural integrity of the piece.
This does not affect any mandatory consumer rights that cannot be excluded or limited by law.
13. Limitation of Liability
FusionGlassArt shall not be liable for indirect damages, loss of profit, or consequential damages, except in cases of intent or gross negligence.
Liability for carrier-related damage or delay is excluded to the extent permitted by law.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is not permitted by applicable mandatory law.
14. Business Customers
For business customers, statutory consumer protection rights do not apply to the extent permitted by applicable law.
FusionGlassArt reserves the right to apply different pricing, minimum order quantities, and contractual terms for business customers.
15. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of the Kingdom of Thailand, excluding conflict of law rules.
The place of jurisdiction, where legally permissible, is Thailand.
This does not affect any mandatory consumer rights that cannot be excluded or limited by law.
16. Severability Clause
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain unaffected.
